1. Acceptance of Terms
By downloading, installing, or using The Lyst (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and The Lyst ("we," "us," or "our").
2. Eligibility and Account Registration
You must be at least 13 years of age to use the App. If you are under 18, you represent that you have the consent of a parent or guardian. You are responsible for maintaining the confidentiality of your Firebase-authenticated login credentials and agree to notify us immediately of unauthorized account use.
3. Description of Service
The Lyst provides a social recommendation platform allowing users to curate lists of media and physical locations, including movies, TV, games, books, podcasts, restaurants, attractions, stays, and destinations. The App includes a Co-owner feature for shared list management and a Secret Mode for private entries.
4. User-Generated Content & Conduct
You retain ownership of the specific text or custom notes you add to your lists. By posting content, you grant The Lyst a worldwide, non-exclusive, royalty-free license to host, store, and display that content to you and your designated Co-owners.
You agree not to use the App for illegal purposes, post hate-speech recommendations, reverse-engineer the App or bypass API limits, or use Co-owner functions to stalk or harass other users.
5. Third-Party Content and Affiliate Disclosure
The App pulls data from third-party APIs including TMDB, IGDB, Listen Notes, Google Places, and other content sources. We do not guarantee the accuracy of this metadata. The App may contain affiliate links, and we may receive a commission if you make a purchase after clicking a link, at no additional cost to you.
6. Intellectual Property
The App's brand, logo, Secret Mode functionality, UI design, and code are the property of The Lyst. You may not copy, modify, or distribute any part of the App without express written permission.
7. Privacy and Data Usage
Your use of the App is also governed by our Privacy Policy, which includes our use of Firebase for data storage and Google AdMob for advertising.
8. Advertisements and Promotions
The App displays ads via Google AdMob. Your correspondence or business dealings with advertisers found on or through the App are solely between you and such advertiser.
9. Limitation of Liability
To the maximum extent permitted by law, The Lyst shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses resulting from your access to or use of, or inability to access or use, the App.
10. Secret Mode and Shared Access Disclaimer
Secret Mode is designed to hide specific data from a Co-owner. While we strive for technical perfection, we do not guarantee that data will remain hidden in the event of technical bugs, database breaches, or shared device access.
11. Modifications to Service
We reserve the right to modify or discontinue the App or any features, including specific API categories, temporarily or permanently, with or without notice.
12. Termination
We may terminate or suspend your account and access to the App if you breach these Terms or if we determine suspension is necessary to protect the service.
13. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
